HP REWARD POINTS TERMS

1. Definitions:
   • “Claim” means a claim lodged by a Participant that the Participant has sold Eligible Products during the Promotion Period and in accordance with these Program Terms.
   • “Eligible Products” means HP Original Ink and Toner sold by Participating Partner to an End User identified in the Eligible Products List – ANNEX A, and which originate, directly or indirectly, from the Promoter.
   • “Promoter” means HP Inc Hong Kong Limited, 25/F, One CityPlaza, 1111 King’s Road, Tai Koo Shing, Hong Kong
   • “Promotional Period” commences at 09.00AM HKST on 12 December 2016 and ends at 11.59PM HKST on 31 October 2022 which Promoter may extend per its sole decision.
   • “Final Claims Date” means 11.59PM (HKST) on 31 October 2022.
   • “Participating Partner” is an authorized HP reseller.
   • “Reward” means a good set out in Annex (B) which can be claimed using reward points earned by Participants buying Eligible Products in Hong Kong from Participating Partner.
   • “Source” means an HP authorized wholesale supplier of Eligible Products within Hong Kong.
   • “Participant” means a resident of, or registered business trading in, Hong Kong who purchases an Eligible Product from a Participating Partner in Hong Kong during the Promotional Period and is the End User of the Eligible Product. The Promoter, its related companies, resellers of HP products and any agencies associated with this Promotion, as well as each of these entities’ employees and those employees immediate families are ineligible to participate.
   • “End User” is an individual who purchases an Eligible Product (from a participating Reseller), for his, her or its own personal use in Hong Kong and not for resale, re-supply or export.
2. Entry to the HP FUNCLUB LOYALTY reward PROGRAM is only open to End User in respect of their business within Hong Kong. The Promoter and agencies or Sources associated with this promotion, and their immediate families, are not eligible to enter.
3. The Program allows Participant to accumulate Reward points during the Promotional Period. It is each Participant sole responsibility to review and understand Reseller’s policies regarding eligibility to participate in trade promotions. If a Participant participates in violation of Reseller’s policies, the Participant may be disqualified from entering or receiving Rewards. Promoter disclaims any and all liability or responsibility for disputes arising between a Participant and Reseller related to this matter, and Rewards will only be provided in compliance with Reseller’s policies. For each Participant, the maximum Reward points collected in a continuous 12-month period shall be no more than 10,000 points.
4. To enter the Promotion and make a Claim the following steps must be completed:
   1. during the Promotional Period, the Participant must purchase Eligible Products from Participating Partner in Hong Kong;
   2. for purchase done before 31 October 2022, the Participant must fully and correctly lodge a claim at www.hp.com.hk/hpfunclub by 11.59PM (HKST) 31 October 2022, and
      1. provide the following correct details in the online Promotion entry form: Participant first name, Participant last name, Participant email address, Participant delivery address, Eligible Product Part Number, Eligible Product QR code Number, Eligible Product Sale Price, corresponding tax invoice for the sales of Eligible Products; and
      2. upload the photo of QR code label cut out from the packing box and the corresponding tax invoice to the Promotion website at www.hp.com.hk/hpfunclub as a PDF, JPG or other supported file type using the document upload facility that will be provided at the website. The corresponding tax invoice submitted must contain the following:
         1. Reseller name, company number and address;
         2. Sale date;
         3. Sale price;
         4. List of Eligible Products sold; and
         5. Invoice number
         While multiple Claims are permitted, each particular tax invoice can only be used for one Claim.
   3. Reward points will be computed in accordance. Only sales made to End Users shall be eligible for Reward points. The Reward points will be granted only to and for the benefit of the individual Participant, and not to the Reseller, its agents or contractors. Reward points earned will be updated on a weekly basis based upon verification of Claims lodged.
   4. Reward Redemption
      1. Reward points can be redeemed at www.hp.com.hk/hpfunclub for items listed in this document. All points granted have a validity period for 18 months.
      2. Participants can make redemptions as long as they have sufficient points, subject to the smallest value of the redeemable item. Redemption requests will only be processed monthly on the 20^th of the month. Please allow up to approximately 75 days for receipt of redeemed item.
      3. Reward points cannot be combined with or used in conjunction with any other promotion, coupon, discount or other special pricing offers of HP.
      4. HP shall have the right to make any final and conclusive decision in relation to any disputes arising out of or concerning the Program, including, without limitation, disputes over points redemption and Rewards under the Program. The recipients of Rewards under the Program may be subject to local taxation laws, and where, for any reason, tax is imposed on any benefits or rewards granted under the Program, the recipient of such benefits or Rewards shall be solely responsible for settlement of such tax
      5. All Rewards are subject to availability of goods in ANNEX B and any restriction may apply as to where and when the Rewards may be redeemed. HP reserves the right, at its sole discretion, to discontinue an item or to substitute a similar item of equal value at any time after notification prior to that item being redeemed. HP provides no guarantee that any Rewards will remain available for the entire term of the Program
      6. HP may, at its sole determination, deduct from Participant’s points balance and/or, when redeemed, claim back from Participant:
         1. Any points suspected to be fraudulently recorded or earned by Participant;
         2. Any points recorded in error;
         3. Any points relating to a transaction which is cancelled; and/or
         4. Any points granted in violation of the Program Terms
      7. If the versions of Annex A and Annex B provided on www.hp.com.hk/hpfunclub are different from the Annex A and Annex B of this Terms, the ones on www.hp.com.hk/hpfunclub shall control.
5. If the Reward Claim meets the Promotion terms and conditions, the Participant will receive a claim approval email to the email address.
6. Claims will be deemed invalid if the same tax invoice number is used on more than one Claim.
7. If a liability for fringe benefits tax (“FBT”) arises as a result of or in connection with the Rewards offered in this promotion, the liability for this FBT and its calculation is the responsibility of the Participant. HP is not responsible for any penalties that the Participant may incur and will not be reimbursing any FBT. The Participant should seek its own taxation advice, if in doubt about the applicability of any FBT
8. This Promotion is not valid in conjunction with any other offer or promotional product bundle/offer.
9. Information on how to enter this Promotion and redemption details form part of these terms and conditions. By submitting an entry, Participant agrees to these terms and conditions.
10. Participant must purchase an Eligible Product, obtained from a Participating Partner, during the Promotion Period, and submit a Claim. Validation is based on the submission of an End User tax invoice. The Promoter reserves the right to verify the validity of each Claim. The Promoter reserves the right to disqualify any Participant or person tampering with the entry process or any Participant who does not meet the eligibility requirements or who does not comply with these Terms and Conditions.
11. All entries must be submitted by 11.59PM (HKST) on 31 October 2022. Participants will forfeit submissions not made by any of these dates.
12. The Promoter’s decision on all matters pertaining to this Promotion is final and binding and no correspondence will be entered into, except as otherwise stated in these terms and conditions. To the extent permitted by law, the Promoter reserves the right to change, amend or terminate the Promotion at any stage during the Promotional Period.  The Promoter reserves the right to verify the validity of each entry and if an entry is invalid the Promoter reserves the right to decline or take back any Rewards provided as part of the Promotion. The Promoter reserves the right to disqualify any Participant or person tampering with, or conspiring with another person to tamper with, the entry process or any entrant who does not meet the eligibility requirements or does not comply with these terms and conditions.
13. To the extent permitted by law, the Promoter shall not be liable for any fault pertaining to any Reward manufactured or supplied by a third-party.
14. The Promoter will accept no responsibility for late, lost or misdirected mail. Further the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect, consequential or economic loss), or for any personal injury suffered or sustained, as a result of participating in this Promotion, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorized intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to Participants' or any other person’s computer related to or resulting from participation in or downloading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows a Participant to automatically enter repeatedly is prohibited and will render all entries submitted by that Participant invalid. If the Promoter has not entered into any correspondence with the Participant prior to the Closing Date of this Promotion, it is the responsibility of the Participant to contact the Promotion to ensure their claim has been received and/or been verified.
15. All Claims become the property of the Promoter. The Promoter collects your personal details in order to conduct this Promotion, and may pass that information to its related bodies corporate and agencies assisting with the promotion, which may be outside Hong Kong. If the information requested is not provided, you may not participate in this Promotion. The Promoter will use the information contained in the entry form to contact you if it has any queries regarding Claims, and to send prizes. If you give your consent HP may contact you from time to time with information about special offers and products and services that may interest you, but you may unsubscribe later if you no longer wish to receive further marketing information.
16. All entries become the property of the Promoter. The Promoter collects personal information in order to conduct the Promotion. Claiming is conditional on providing this information. The Promoter will use the information contained in the Promotion claim form to contact Participants if it has any queries regarding claims, and where to send Rewards. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to its related bodies corporate and agencies assisting with the Promotion, which may be outside the participating country and as required, to regulatory authorities in Hong Kong. If the information requested is not provided, the Participant may not participate in this Promotion. The Promoter’s privacy policy can be viewed at http://www8.hp.com/hk/en/privacy/privacy.html
17. These terms and conditions shall be governed by and construed in accordance with the laws in force in Hong Kong. Participants submit to the exclusive jurisdiction of the courts of Hong Kong.
